Topic: C-PACE is a new, fast-growing financing tool for construction or renovation of commercial and industrial buildings. C-PACE loans are designed to fund up to 100% of energy efficiency or renewable energy projects, helping the property owner lower their future energy costs while benefitting from lower-cost, more flexible financing. In 2019, Montgomery County enacted its own C-PACE program and the Montgomery County Redevelopment Authority is actively engaged in facilitating funding requests. As C-PACE becomes more widely used, attorneys, developers, and lenders must learn the regulatory framework and local guidelines for this unique financing tool. The panel, including a C-PACE capital provider, an experienced C-PACE administrator, and an environmental and energy law attorney, will provide a dynamic overview of the benefits and challenges of C-PACE and how to use it for Montgomery County projects.
Topics to be covered include:
o C-PACE Basics:
o Why use C-PACE?
o Eligibility requirements
o Project approval process
o C-PACE Process:
o Structuring and documentation of transactions
o Repayment through additional assessment on property taxes
o Legal issues, including lender consent
o C-PACE Success Stories:
o A discussion of the current state of the C-PACE market and recent successful C-PACE transactions.
