Topic: Can a Borough or School District sell land it no longer needs? Maybe and maybe not. Recent cases, In Re: Petition of the Borough of Downingtown and Board of Directors of the Hatboro-Horsham School District v. Ambler, have arguably changed the law in this regard. Can a School District condemn land it needs for a new school? Maybe not - if it has a conservation easement or farmland easement on it. Act 45 of 2018 definitely changed the law.
